The Worksite Investigation Enforcement Unit of the Immigration and Customs Enforcement (ICE) agency has come out in the past month against the pre-population of information on Section 1 of the Form I-9, the employment eligibility verification document used for all new hires.

ICE maintains, in a break with past policy, that each new hire must complete Section 1 in his or her own handwriting and that the employer cannot pre-populate any of the information either electronically or by manual printing methods.

ICE officials refused to back down on this revised requirement when confronted at a recent meeting with a committee of the American Immigration Lawyers Association.

The new requirement is particularly challenging for firms that use electronic I-9 filing systems that integrate with other human resource documents and sometimes pre-populate certain sections of the I-9.
