The Spring Regulatory Agenda published recently by the Department of Labor (DOL) lists November 2014 as the issue date for proposed new regulations on overtime pay exemptions.

Currently, under rules issued in 2005 employees in executive, administrative, professional, outside sales and computer positions earning a minimum of $455 a week can be classified as exempt employees, meaning their salary is set in stone and no overtime pay will be paid.

The DOL is reworking the rule at the request of President Obama, who in March complained that “an exception that was originally meant for high-paid, white-collar employees now covers workers earning as little as $23,660 a year,”

Though the agenda lists only November, one can be sure it will be after the Nov. 4 national election when the U.S. Senate looks to be up for grabs.
