The Department of Labor (DOL) yesterday published a new set of Frequently Asked Questions (FAQs) regarding implementation of the Affordable Care Act (ACA), dealing primarily with the upcoming Marketplace Notice of Coverage Options and the 2014 implementation of the 90-day-waiting-period limitation for employer-provided health plans.

Significantly, the FAQs clarify that Marketplace Notices issued, for instance, by insurers to all the insured under a company's health plan do not relieve that company of its requirement to notify all employees, even those not covered on the company plan, of the availability of the Marketplace options commencing Oct. 1.

The 90-day-waiting-period limitation on employees' qualifying for coverage under a company's health plan goes into effect on Jan. 1, 2014, the FAQs affirm, clarifying some confusion in the business community.
