In a long-shot gamble likely to be rejected, the Pacific Legal Foundation today filed a petition with the Supreme Court, arguing that Obamacare is unconstitutional because the Patient Protection and Affordable Care Act (PPACA) violates the Constitution’s Origination Clause, which stipulates that bills “for raising revenue” begin in the House of Representatives.
The petition states: “The PPACA did not originate in the House, but in the Senate, which erased the entire text of a House-passed bill relating to a different subject and replaced it with what became PPACA.”
The argument has already been rejected by the D.C. Circuit Court of Appeals, where even four Republicans who agreed with the argument said they would side with the White House in the dispute.
